This Privacy Policy explains how we manage the collection, use, disclosure and handling of personal information of persons with who we interact in accordance with the privacy laws including the applicable Australian Privacy Principles contained in the Privacy Act.

By accessing or using our website, requesting we provide you with any services (including health services), or you make disclosure to us of your personal information, you agree to the collection, use, handling and disclosure of your personal information in the manner set out in this Privacy Policy.

How LBL collects your personal information will largely depend on whose information it is collecting. If it is reasonable and practicable to do so, LBL will collect personal information directly from you.

Depending on how you choose to interact with LBL, LBL may collect your personal information when you contact LBL by telephone, by email, through our website or when you complete a form or document and provide it to LBL.

Collecting information from third parties

in an emergency, where LBL may need to collect the client’s background health information from relatives, other health service providers or applicable government agency; or

where a client is a child, or an adult who lacks capacity, information may need to be collected from the parents, guardians or relatives.

 the services which are to be provided by us to you;

 sensitive information (including health information) which is reasonably required in order for  us and our related entities to lawfully provide our services to you; and

 records of transactions and communications between you, us, and/or third parties in connection with our supply of services to you.

Sensitive information can include information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information

HOW IS PERSONAL INFORMATION DISCLOSED TO OTHERS?

LBL can use or disclose health information with your consent.

LBL may also be required to use or disclose health information where:

the use meets general community expectations of how information flows within the health system;

you understand how the information will be handled;

required or authorised by law;

the use or disclosure is necessary to lessen or prevent a serious threat to the life, health or safety of any individual, or to public health and safety;

conducting research, or the compilation or analysis of statistics;

the disclosure is to a responsible person for an individual;

the use or disclosure is necessary for enforcement related activities;

to take appropriate action in relation to suspected unlawful activity or serious misconduct;

to locate a missing person;

   it is used to establish, exercise or defend a legal or equitable claim; or

   it is used for a confidential alternative dispute resolution process.

LBL is unlikely to disclose your information outside of Australia, although may do so in accordance with this paragraph 5.

ACCESS TO YOUR PERSONAL INFORMATION AND ACCURACY

You have a right to access personal information held by us about you and to correct any information about you that is not correct at that time.

Please contact LBL using the contact details in paragraph ‎9 below if you wish to request access to the personal information which LBL holds about you or any of the personal information that LBL holds about you is not correct.

In certain circumstances, LBL may not be able to provide you with access or correct your personal information. In these circumstances, LBL will write to you to explain and provide the reasons why.

 

SECURITY

LBL will take commercially reasonable steps to ensure personal information collected by us is stored securely to reasonably protect your personal information from the misuse, loss and unauthorised access, modifications or disclosure.

 

HOW YOU MAY COMPLAIN IF YOU HAVE CONCERNS ABOUT HOW LBL HAS MANAGED YOUR PERSONAL INFORMATION

If you have a complaint related to how LBL has managed your personal information, please contact LBL using the contact information below. LBL may ask you to place your concerns in writing in order for it to fully understand and investigate the issues you have raised. All such complaints will be handled with the appropriate discretion.

If a compliant remains unresolved, you may access an external dispute resolution service or apply to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au to have the complaint heard and determined.

This Privacy Policy is subject to change at any time. If LBL changes this Privacy Policy, an updated version will be posted on our website to notify you of this change. By continuing to access our website or our services you will be deemed to have irrevocably accepted any changes to this Privacy Policy.

 

DEFINED TERMS

In this Privacy Policy, unless the context indicates otherwise:

a term defined by the Privacy Act has the same meaning when used in this Privacy Policy; and

the following words have the correspondence meaning:

approved provider has the meaning given by Aged Care Act 1997 (Cth);

collect or collection includes, but is not limited to:

recording what a person says, or recording an opinion about what a person has said;

requiring a person to complete a form requesting details such as name, address, date of birth and health information; and

keeping emails or other correspondence containing personal information about a person; and

Privacy Act means the Privacy Act 1988 (Cth).
